TERMS & CONDITIONS
It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
Booking Fee:
The Booking Fee of 25% of the total price to secures the date, time and services of Noah’s Way Photography for the wedding and is non-refundable or non-transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation. All cancellations must be in writing. Weddings that are postponed to a later date will retain the fee as long as the photographer can re-schedule for the new date and time within the same year or if moving to a new year the new package pricing applies.
Payment Terms:
Following payment of the booking fee, the total balance of fees is to be paid two weeks prior to the wedding date.
Noah’s Way Photography accepts bank transfers only.
Noah’s Way Photography may use any images included in this contract in their portfolio, literature. They may also be used on the website, email and social media channels.
Wedding Day Timeline & Agenda:
All the couples should send the agenda/ timeline of the Wedding Day before one month of the wedding and we will review it within 7 days and give the couple a call to discuss it in details.
Where the couple had not sent it before a month from the wedding we will be contacting them only two weeks before the wedding date.
Copyright:
Any images or copies of images whether stored digitally or otherwise and any computer files or printed documentation relating to such images remain the copyright of Noah’s Way Photography. It is illegal to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the written permission of Noah’s Way Photography for commercial use, however, the Clients shall have the right to use images for personal, non-commercial purposes including display on personal websites, social media, the reproduction of prints for self and as gifts, and for the publication of wedding-related announcements or articles.
Attendance:
In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer to attend your wedding on our behalf to undertake the Wedding photography to the best of their ability.
Cancellation:
The Client may cancel this contract at any time by giving written notice to Noah’s Way Photography but in doing so shall forfeit any monies paid.
Resheduling:
Will incur an additional fee. Rescheduling to a Saturday will be $400 and rescheduling to a weekday will be $250.
Agenda:
Wedding Day Agenda and the photo shot list must be provided one month before the wedding date.
Confirmation:
We accept the responsibility to contact the Photographer at least two weeks prior to the wedding date to confirm details are correct and there are no alterations.
Requirements:
If the photographer is required to be at the reception, a meal should be provided.
We agree to advise the hairdressers, make-up artists, the hire cars, and anyone else involved with providing services for the wedding of all the relevant times, details, and locations as detailed, and to coordinate their services.
The details and times listed form part of this agreement, and we agree to make every effort to cooperate in order for the Photographer to fulfill the contracted photographic services.
We acknowledge the Photographer cannot accept responsibility for the extent of the photographic coverage if these details are incorrect or if the agreed schedule was not followed.
Group Photos:
If specified people on the family group shot list are not available to be photographed at the allocated time, it is not the photographer’s responsibility.
Couple Photos:
If the couple do not cooperate for the photos, it is not the photographer’s responsibility.
Photo Delivery:
Client Gallery for selections will be provided to the nominated email within 2-3 days of the wedding for selections, and the final completed edits will be provided within 8 weeks via email.
Customized Pendrive Delivery
This will happen in bulk so the times may vary. But we try to deliver this ASAP following the photo delivery via our client Gallery.
* By completing the deposit payment the Couple agree to Noah’s Way Photography Terms & Conditions.
